Welcome to Whiskey Foxtrot Designs. This website is operated by Whiskey Foxtrot Designs, LLC. Throughout these Terms, “we,” “us,” and “our” refer to Whiskey Foxtrot Designs, LLC.

These Terms govern your use of whiskeyfoxtrotdesigns.com and purchases made through our online store. Please review them along with our Return and Refund Policy, Shipping Policy, and Privacy Policy before ordering.

1. Using Our Store

You must have the legal capacity to enter into a purchase agreement under applicable law or act with the authorization of a parent or legal guardian.

You agree to provide accurate contact, billing, shipping, and order information and to use a payment method you are authorized to use.

You may not use our website or products for unlawful purposes, submit fraudulent orders, infringe another person’s rights, or interfere with the operation or security of our website.

2. Products and Handmade Variations

We offer handcrafted, engraved, personalized, and other gift products. We make reasonable efforts to describe and photograph products accurately.

Natural materials and handmade processes create variations in wood grain, color, texture, engraving contrast, and placement. Screen settings can also affect how colors appear. Product photographs and digital previews are representative; individual items may differ slightly.

Normal variations consistent with the product description are part of the product’s character. This does not excuse defects, incorrect personalization by us, or products that materially differ from their descriptions.

3. Personalized and Custom Orders

Please carefully review names, spelling, dates, initials, design selections, and other customization details before submitting an order.

We produce personalized items using the information you provide and any proof you approve. Unless a proof is included in the listing or separately agreed upon, a proof is not automatically provided.

When we provide a proof requiring approval, production will wait for your approval. Delayed responses may affect the production schedule, and we will communicate any necessary changes.

Changes are subject to our confirmation and may not be possible after customization begins. Customer-provided errors reproduced accurately are not considered production defects. Any agreed remake or revision charges will be disclosed before additional work begins.

If we make an error, please contact us so we can resolve it under our Return and Refund Policy.

4. Customer-Provided Artwork

By submitting artwork, photographs, logos, text, or other material, you confirm that you own it or have permission to authorize its use for your order.

You grant us limited permission to reproduce and adapt that material as reasonably necessary to prepare proofs and complete your order. You retain any ownership rights you have in the submitted material.

This permission does not authorize us to use your submitted material in advertising; we will request separate permission for that use.

We may decline requests involving unlawful content or content we reasonably believe infringes another party’s rights. Payment for work we decline and do not perform will be refunded.

5. Prices, Payment, and Order Issues

Prices are displayed in the currency identified by our store or checkout. Applicable taxes, shipping charges, and selected customization charges are shown before you complete your purchase.

Payment is required at checkout unless we agree otherwise in writing.

We may change prices for future purchases. Price changes do not automatically change an order already placed.

If an availability issue, significant listing error, payment problem, or suspected fraud affects your order, we will contact you when reasonably possible. We will not charge an increased price without your agreement. If we cancel an order, we will refund amounts paid for the canceled portion, including applicable taxes and shipping charges.

6. Cancellations, Returns, and Refunds

Our Return and Refund Policy explains eligibility, deadlines, conditions, and how to request assistance.

Standard orders may be canceled before shipment. Personalized or custom orders may be canceled before customization begins. Please contact us promptly; cancellation or change requests must be confirmed by us.

Once customization begins, personalized or custom orders cannot be canceled or returned for a change of mind, except where required by law.

These restrictions do not remove your rights concerning defective products, shipping damage, incorrect items, or errors made by us.

7. Production and Shipping

Production time and carrier transit time are separate. Please review the product listing, checkout information, and Shipping Policy for applicable estimates.

Carrier delivery dates are estimates unless we expressly offer a guaranteed delivery service.

If we cannot ship within the stated timeframe—or the timeframe required by applicable law—we will notify you and offer the choice of agreeing to a revised shipment date or canceling the unshipped merchandise for a prompt refund.

Please provide a complete, accurate shipping address and contact us immediately if it needs correction. Address changes may not be possible after shipment. Any additional shipping charges resulting from an incorrect customer-provided address will be explained before reshipment.

If an order arrives damaged or appears lost, contact us so we can investigate and help resolve the issue.

8. Product Care and Safety

Use products only for their intended purposes and follow all supplied care instructions, warnings, and manufacturer guidance.

Never leave a burning candle unattended. Keep burning candles away from children, pets, and flammable materials, and follow the candle’s safety label.

Damage resulting from misuse, improper care, or unauthorized alterations may fall outside our voluntary return coverage. This does not limit rights or remedies that applicable law provides.

9. Intellectual Property

Our branding, original designs, photographs, text, and other website content belong to us or their respective owners and licensors.

Purchasing a physical product does not transfer copyright, trademark rights, or permission to reproduce its design. Commercial reproduction of protected content requires permission from the appropriate rights holder.

10. Privacy and Third-Party Services

Our Privacy Policy explains how personal information is collected, used, and shared.

Our store is hosted by Shopify, which provides the ecommerce platform we use to sell our products. Purchases from this store are transactions with Whiskey Foxtrot Designs, LLC.

Third-party services and websites may have their own terms and privacy policies. We do not control the content or operation of external websites.

11. Your Legal Rights and Governing Law

Nothing in these Terms excludes or limits consumer rights, warranties, remedies, or liability that cannot lawfully be excluded or limited.

These Terms are governed by applicable Nebraska and United States law, without depriving consumers of mandatory protections available under other applicable laws.

If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

12. Changes and Contact Information

We may update these Terms by posting a revised version with an updated date. Changes apply prospectively and will not retroactively reduce rights associated with an existing order.
